I don’t think you’ve got your ducks lined up right – carefully shepherded cases, a sequence of law review articles laying out the logic – to bring it in and land it as a final form, but there are live cases out there and the infrastructure to escalate them to Trump-leavened circuits and these Supremes to make the first chips before an issue could turn into a filing and a ruling (especially in the face of defense delays anticipating that change)
