During the Obama years, the ambitious large Republican states (so, Texas) filed suit against administration initiatives (Obamacare, DACA) in federal courts in remote regions of their states with a good chance of this one oddball judge going their way

under Trump, Dem states (CA, WA) have been doing the same but the trends been going long enough the nonpartisan bar’s been working up antibodies already, I hear different streams of “end forum-shopping” and “end nationwide injunctions from subnational courts”

But there was this one LEFT trick under Obama, California did it with its initiative-passed gay marriage ban and I remember it coming up somewhere else, of an executive in charge of legal process inviting a friendly-sourced lawsuit and just declining to defend it, which under our adverserial legal system generated results that wouldn’t be approved and couldn’t be rejected by any voter-accountable agent
