I have no idea about American tax law, but maybe it’s time to just treat people employed by a church as employees.
Churches as nonprofits is like Amerindian tribes as sovereignties, the concept is their authority predates the state
(before the New Deal, old age/orphan/widows’ care was on counties [on “Almshouse Road” in my hometown colonial county] because they were the secular successor to parishes)
